JUSTICE SUDHIR SINGH ORAL ORDER 10-02-2016 Heard learned counsel for the petitioner and the State. The petitioner is apprehending his arrest in a case instituted under Sections 406, 408, 409, 420 and 201 of the Indian Penal Code.
Allegation against the petitioner is that he has embezzled public money.
It is submitted on behalf of the petitioner that he has got no criminal antecedent. He has been made accused due to mistake of fact. There is no defalcation of public money made by the petitioner. It is further submitted that petitioner is ready to deposit an amount of Rs.10 lacs in the court below within a period of six months which shall be subject to the final disposal of the case. On behalf of the State, it is submitted that petitioner is named in the F.I.R. and has made defalcation of public money. Considering the aforesaid facts and circumstances, it is directed that petitioner shall deposit an amount of Rs.10 lacs within a period of six months from the date of receipt/production of a copy of this order.
In the meanwhile, the above named petitioner shall be
Patna High Court Cr.Misc. No.50927 of 2015 (3) dt.10-02-2016 2/2 granted provisional bail on furnishing bail bond of Rs. 10,000/- (Ten thousand only) with two sureties of the like amount each to the satisfaction of Smt. Ranjula Bharti, learned Judicial Magistrate, Ist Class, Samastipur, in connection with Warisnagar P.S. Case no. 2 of 2015. Once the entire amount of Rs.10 lacs is deposited within a period of six months in the court, the provisional bail granted to the petitioner shall be confirmed by the court below.
