====================================================== CORAM: HONOURABLE MR. JUSTICE SUDHIR SINGH ORAL ORDER 27-06-2019 Heard learned counsel for the petitioner and learned counsel for the State.
The petitioner is languishing in custody since 09.05.2019 in a case for the offence registered under Section 366(A)/34 of the IPC.
The prosecution story, in brief, is that on 06.10.2010 while the informant with his family members was sleeping in house, at 11.00 P.M. his daughter went to ease herself. After sometime, he heard of cry of his daughter. When he and his wife reached, they saw Ladle (petitioner) and two other persons dragging away his daughter. When he reached there they brandished a pistol and took away his daughter on a red coloured Bolero.
It has been submitted by learned counsel for the
Patna High Court CR. MISC. No.39276 of 2019(2) dt.27-06-2019 2/2 petitioner that the petitioner has got no criminal antecedent. There is no allegation of tampering with the witnesses alleged against the petitioner. The victim has been examined under Section 164 of Cr. P.C. From perusal of Annexure-3, it is evident that the petitioner and the victim have got married and the matter has been settled between the parties. On behalf of the State, it is submitted that the petitioner is named in the F.I.R/ Complaint Case. Considering the aforesaid facts and circumstances, let the petitioner above named, be released on bail on furnishing bail bonds of Rs.10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned Ist Additional Sessions Judge, East Champaran, Motihari, in connection with Trial No. 399 of 2018, arising out of Mehsi P.S. Case No. 105 of 2010.
