JUSTICE RAKESH KUMAR ORAL ORDER 19-09-2017 Heard Sri Krishna Chandra, learned counsel for the petitioner and Dr. Ajit Kumar, learned Addl. Public Prosecutor. The sole petitioner, who is in custody since 06-06-2017 in Supaul P.S. Case No. 463 of 2016 registered for offence under Sections 47(A) and 51 of Bihar Excise (Amendment) Act, 2016, has prayed for grant of bail. It was submitted by learned counsel for the petitioner that petitioner was having no concern with the truck, from which, allegedly huge quantity of Indian make foreign liquor was recovered. He submits that petitioner has been made accused only on assumption that tyre mark was found near the brick-klin of the petitioner, whereas, the said truck was intercepted about 8 km. away from the brick-klin of the

Learned counsel for the petitioner has drawn my attention to statement made in paragraph - 3 of the petition to show that petitioner is having clean antecedent. Considering the nature of accusation, clean antecedent and period of custody, let the petitioner namely Sanjeev Kumar Jha @ Sanjeev Kumar Mishra be enlarged on bail on furnishing bail-bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned Additional District Judge - II, Supaul in connection with S.T. (Excise) - 576 of 2017, arising out of Supaul P.S. Case No. 463 of 2016. (Rakesh Kumar, J.) anay U T
