JUSTICE JITENDRA KUMAR ORAL ORDER 25-06-2025 The present petition has been preferred for modification of the impugned order dated 04.12.2024, passed by this Court in Cr. Misc. 81599 of 2024, wherein the petitioner No. 2 has been stated to have one criminal antecedent. However, learned counsel for the petitioner submits that as a matter of fact, the petitioner No. 2 has one more Criminal antecedent bearing Masrakh P.S. Case No. 535 of 2019 registered for the offences punishable under Sections 272, 273, 464, 468, 471, 414 of the Indian Penal Code and Sections 30(a), 36, 38, 41 of the Excise Act. However, the petitioner No. 2 had failed to mention the above criminal antecedent in his bail application and hence, in the impugned order, there is no reference to the aforesaid
Patna High Court CR. MISC. No.40610 of 2025(2) dt.25-06-2025 2/2 criminal antecedent of the petitioner No. 2. In the impugned order it is also stated that the petitioner No. 1 has no criminal antecedent whereas he has also one criminal antecedent bearing No. Ishuapur P.S. Case No. 75 of 2020 registered for the offences punishable under Sections 143, 341, 504 and 506 of the Indian Penal Code which was later on transferred to Gram Kachahari and compromised.
2. Accordingly, the order dated 4.12.2024 is modified to the extent indicated above.
3. The time for surrendering the petitioners in the court below is extended by further four weeks from today. (Jitendra Kumar, J) S.Ali/- U T
