The petitioner, who is in custody in Pipra P.S. Case No. 52 of 2016 registered for offence under Section 307 & other allied sections of the Indian Penal Code and Section 61 of the Bihar Excise Amendment Act, 2016, has prayed for grant of bail.

It was submitted by learned counsel for the petitioner that petitioner was only shown as a member of mob carrying lathi in his hand and except that, there is no accusation against the petitioner.

However, fact remains that F.I.R. was lodged on an accusation that while police visited for conducting search

Patna High Court Cr.Misc. No.43014 of 2017(2) dt.19-09-2017 2/2 regarding recovery of liquor, the police party was intercepted and assaulted by the member of mob.

Considering the nature of accusation, at the moment, I am not inclined to extend the privilege of bail. Dismissed.
