The petitioner seeks bail in a case registered under Section 7(a) of the Prevention of Corruption Act. Allegation is that the petitioner had taken bribe amounting to Rs.45,000/- from the informant.
It has been submitted on behalf of the petitioner that the petitioner is in custody since 25.12.2018 and has got no criminal antecedent. Charge sheet has been submitted in this case. There is no allegation of tampering of witnesses alleged against the petitioner. The petitioner has been made accused due to mistake of fact. There is no substantive evidence to suggest his implication in the present case. It is further submitted that

No.44158 of 2019(5) dt.07-08-2019 2/2 the petitioner has remained in custody for approximately eight months and he is ready to deposit an amount of Rs.1 lac in the court below, which shall be subject to final disposal of the case. On behalf of the Union of India, it is submitted that the petitioner is named in the F.I.R.
Considering the aforesaid facts and circumstances, the petitioner, above named, is directed to deposit an amount of Rs.1 lac in the court below, which shall be subject to final disposal of the case. On doing so, the petitioner be released on bail on furnishing bail bonds of Rs.10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of learned Special Judge, Vigilance II, Patna in connection with Special case No.25 of 2018 arising out of Nigrani (Vigilance) case No.59 of 2018.
