Petitioner, who is in custody, seeks bail in connection with Amas P.S. Case No. 208 of 2017 registered for the offences punishable under Sections 147, 304(B) & 201 of the Indian Penal Code.
Informant who is father of the deceased has alleged that his daughter was married with Rambarat Bhuiyan (petitioner) 2-3 years ago. After marriage petitioner and other co-accused tortured and assaulted her daughter for Rs. 25,000/- which was not given at the time of marriage. It has been further alleged that on 30.09.2017 her daughter was to come to her Maika but she did not come, then on 01.10.2017 he learnt from elder brother of her husband that from snake bite in the night
Patna High Court Cr.Misc. No.56213 of 2018(3) dt.05-11-2018 2/2 she died.
It has been submitted that petitioner is innocent and has been falsely been implicated in this case on suspicion only. The date of occurrence is on 30.09.2017 but the F.I.R. has been lodged on 03.10.2017 after lapse of three days. During investigation many villagers who have been examined by I.O. has stated that deceased died of snake bite. Petitioner has no criminal antecedent and he is in custody since 20.10.2017. Considering the aforesaid fact and circumstances of the case, let the petitioner named above be released on bail upon furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned Judicial Magistrate, 1st Class, Sherghati at Gaya, in connection with Amas P.S. Case No. 208 of 2017.
