Learned counsel for the petitioner is directed to remove the defects, as pointed out by the office, within a period of four weeks. In the eventuality of non-removal of defects within undertaken period, the office will place the matter before the Bench.
Vide order dated 10.05.2022, notice was issued to opposite party no.2 but the notice has not been served and it has returned unsersed as the opposite party no.2 was not present at his house and the house was locked.
The petitioner apprehends his arrest in a case
Patna High Court CR. MISC. No.52689 of 2021(4) dt.17-10-2022 2/3 registered for the offences punishable under Section 147, 148, 149, 341, 448, 323, 324, 307, 354B, 380, 427 and 504 of the Indian Penal Code.
While the complainant was working at her field and went to attend the natural call, the petitioner is said to have caught her, tried to commit rape against her and on hulla he escaped from the place of occurrence.
It is submitted by learned counsel for the petitioner that no such occurrence as alleged ever took place. He has been falsely implicated in this case due old enmity. The allegation levelled against the petitioner is not specific rather general and omnibus in nature. There is specific overt act against one Savitri Devi. There is admitted land dispute between the parties. Both sides have filed cases against each other. Petitioner has no criminal antecedent as mentioned in para-3 of this application.
Having regard to the facts and circumstances of the case, let the above named petitioner, be released on bail, in the event of his arrest or surrender before the learned Court below within a period of six weeks from today, on furnishing bail bond of Rs. 25,000/- (Rupees Twenty Five Thousand) with two sureties of the like amount each to the satisfaction of the learned
Patna High Court CR. MISC. No.52689 of 2021(4) dt.17-10-2022 3/3 Court below where the case is pending/successor Court in connection with Chandramandih P.S. Case No. 95 of 2017, subject to the condition as laid down under Section 438 (2) of the Cr.P.C.
