The petitioners seek pre-arrest bail in connection with Nokha P.S. Case No. 167 of 2015 registered under sections 406 and 420 of the Indian Penal Code.
It is contended that the dispute, if any, is of civil nature. Though the complainant has alleged that he had sold paddy worth rupees four lakhs to the petitioners, the payment has not been made to him but there is no document to support such contention. Learned counsel for the State has opposed the application filed on behalf of the petitioners. Regard being had to the nature of allegation, in the event
Patna High Court Cr.Misc. No.50628 of 2015 (2) dt.06-11-2015 2/2 of arrest or surrender in the court below within six weeks from today, the above named petitioners are directed to be released on bail on furnishing bail bonds of Rs.10,000/- (ten thousand) each with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Rohtas, Sasaram in connection with Nokha P.S. Case No.167 of 2015 subject to the conditions as laid down under section 438(2) of the Code of Criminal Procedure.
