The petitioner seeks bail in Mojahidpur (Babarganj) P.S. Case No. 44 of 2021, registered for the offence punishable punishable under Section 30(a) of the Bihar Prohibition and Excise Act, 2018.

09 litres of country made Mahua liquor which was concealed under the pile of Goitha and 68 litres of country made liquor has been recovered from the bank of Mirza pond. It is submitted that no recovery has been made from conscious possession of this petitioner. Recovery has been made from open place which is accessible to general public and petitioner has got nothing to do with the alleged recovery and he is in custody since 26.07.2021. Investigation is complete.

No.54876 of 2021(2) dt.06-12-2021 2/2 Considering the period of custody, the petitioner above-named, is directed to be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of the learned Additinal Sessions Judge 2nd-cum-Special Judge Excise Act, Bhagalpur in connection with Mojahidpur (Babarganj) P.S. Case No. 44 of 2021.
