The petitioner, invoking writ jurisdiction of this court under Article 226 of the Constitution of India, has prayed for directing the respondents for granting certificate / licence to establish for running 18" radius vertical and circular saw mill for the purposes of making furniture.
Learned counsel for the petitioner submits that though petitioner has filed an application before the Divisional Forest Officer, Muzaffarpur on 15.5.2012 till date no decision has been taken.
The court is of the opinion that without going into the
Patna High Court CWJC No.6526 of 2014 (2) dt.06-08-2015 2/2 merit of the case the writ petition can be disposed of granting liberty to file a fresh representation before the respondent no. 4. If such representation is filed within a period of six weeks, the respondent no. 4 may examine the same in accordance with law particularly keeping in view the Government resolution issued in the year 2012 and pass appropriate order preferably within a period of three months from the date of filing of such application. The writ petition stands disposed of.
