The petitioner is in custody since 19.04.2019 in connection with Maniyari P.S. Case No. 80 of 2019 for the offence registered under Sections 30(a) of the Bihar Prohibition and Excise Act, 2016.

Learned counsel for the petitioner submits that the alleged recovery was made from the truck in which the petitioner was only passenger. It is further submitted that the petitioner has no knowledge of the loaded liquor in the alleged truck. It is further submitted that the petitioner is neither the driver nor the truck owner.

Considering the aforesaid facts and circumstances of the case, let the petitioner, above named, be released on bail on

Patna High Court CR. MISC. No.47440 of 2019(4) dt.05-09-2019 2/2 furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of Special Judge, Excise Act, Muzuffarpur in connection with Maniyari P.S. Case No. 80 of 2019.
