The petitioners seek bail in Puraini P.S. Case No. 152 of 2020, registered for the offence punishable under Sections 307, 379, 323 and other allied sections of the Indian Penal Code. As per the FIR, petitioner no. 1 is said to have assaulted the husband of informant by means of iron rod on his head and petitioner no. 2 assaulted him by means of Dabiya. It is submitted on behalf of the petitioners that the occurrence took place on 25.08.2020, but the FIR was lodged on 02.09.2020 i.e. delay of nine days for which there is no plausible explanation. As per the FIR four persons including petitioners are alleged to have assaulted the husband of

Patna High Court CR. MISC. No.52532 of 2021(3) dt.21-01-2022 2/2 informant, but only two injuries caused on the person of injured. The doctor has found injury no. 1 to be grievous and injury no. 2 to be simple in nature Petitioners are in custody since 27.06.2021 having clean antecedent.

Considering the facts and circumstances of the case and the period of custody, the petitioners above-named, are directed to be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Ten thousand) each with two sureties of the like amount each to the satisfaction of the learned Additional Chief Judicial Magistrate II, Udakishunganj, Madhepura in connection with Puraini P.S. Case No. 152 of 2020.
