The petitioner apprehends his arrest in Digha P.S. Case No. 302/2014, registered for the offences punishable under Section 498A and other Sections of the Indian Penal Code and 3⁄4 of the D.P. Act.
The informant is the wife of the petitioner. The informant made allegation that the petitioner after marriage subjected her to physical and mental torture due to non-fulfillment of demand of dowry and drove her out from the house. It is submitted that she is pregnant and she has also got a child.
Learned counsel for the petitioner submits that the
Patna High Court Cr.Misc. No.21810 of 2015 (3) dt.08-10-2015 2/2 petitioner is ready to keep his wife with all honour and dignity. Learned counsel for the informant submitted that the petitioner has already solemnized second marriage with one Mamta Kumari. The petitioner did not give any maintenance to the informant and her children.
Considering the facts aforesaid and the fact that there is allegation that the petitioner subjected his wife to physical and mental torture and he solemnized second marriage, I am not inclined to enlarge the petitioner above named on anticipatory bail. Accordingly, the same is rejected.
