The Petitioner apprehends his arrest in Khagaria (Muffasil) P.S. Case No.562 of 2016 instituted for the offence under Section(s) 341, 323, 324, 307, 354, 379/34 Indian Penal Code.
There is specific allegation against the petitioner of assaulting the informant with sword on her neck, hand and ankle. It is further alleged that this petitioner used to say the informant to sleep with him in absence of her mother-in-law, which was objected by her, as a result of which, the present occurrence was committed by petitioner.
It is submitted on behalf of the petitioner that all the
Patna High Court Cr.Misc. No.62 of 2017 (2) dt.10-01-2017 2/2 injuries found on the person of the informant are simple in nature and co-accused, Indu Devi, has been granted anticipatory bail by a co-ordinate Bench of this Court.
Considering the nature of allegation made by the informant in the written report and also the fact that injuries had been sustained by the informant on her neck, hand and ankle, this Court is not inclined to enlarge the petitioner on anticipatory bail. Prayer of the petitioner for anticipatory bail is rejected.
The petitioner is directed to surrender before the Court below within a period of six weeks from today and seek regular bail, which shall be considered and disposed off on its own merit without being prejudiced by this order. (Sanjay Priya, J) JA/- U T
