The petitioner is languishing in custody for the offences punishable under Sections 302/120B of the Indian Penal Code and Section 27 of the Arms Act.

According to FIR, murder of Mr. Jitendra Singh, an Advocate, was committed near the Water Board Office by some unknown person.

Suspicion was raised against different persons for different reasons for commission of murder. The petitioner is wife of the deceased and suspicion against the petitioner and other relatives of the petitioner is for the reason that matrimonial dispute was going on between the deceased and this petitioner and the petitioner was living since long at her

Patna High Court CR. MISC. No.44933 of 2019(3) dt.30-09-2019 2/2 parents' house in Muzaffarpur Town.

Suspicion was there against co-accused Ritesh Kumar @ Bittu for the reason that mother of the deceased and younger brother of the deceased had sold away two kathas of ancestral property in favour of Ritesh Kumar and Rupesh Kumar but those persons wanted to grab remaining one katha by the side of the land sold. Those, accused were granted bail by this Court in Cr. Misc. No.13765 of 2019.

Considering the fact that only material against the petitioner is suspicion, let the petitioner, above named, be released on bail on furnishing bail bond of Rs.20,000/- (Twenty Thousand) with two sureties of the like amount each to the satisfaction of the learned Court-below where the case is pending in connection with Shastri Nagar P.S. Case No.849 of 2018, with following conditions:

(a) Both the bailors shall be the resident of territorial jurisdiction of the learned Court-below.

(b) The petitioner shall fully cooperate with the trial of the case, failing which the court below shall be at liberty to cancel the bail bond of the petitioner.
