JUSTICE RAJENDRA KUMAR MISHRA ORAL ORDER 02-07-2019 Heard learned counsel for the petitioners and the learned A.P.P. for the State as also the learned counsel for the opposite party no.2.
The petitioners apprehend their arrest in connection with Mahila P.S. Case No.13 of 2019 registered under Sections 498A, 341 and 323/34 of the Indian Penal Code besides Sections 3/4 of the
Patna High Court CR. MISC. No.40492 of 2019(2) dt.02-07-2019 2/2 Dowry Prohibition Act.
The accusation is of torturing the opposite party no.2 by her husband and other in-laws for non-fulfillment of the dowry demand and also removing the opposite party no.2 from the matrimonial house by snatching her personal belongings. Learned counsel for the petitioners submits that the petitioner nos.1 and 5 are brothers-in-law (Nandosis), petitioner nos.2 and 4 are married sisters-in-law (Nanads) and the petitioner no.3, the son of the petitioner nos.1 and 2, is the nephew (Bhagina) of the opposite party no.2 and they have falsely been implicated in this case. The petitioners have no criminal antecedents. Having considered the facts and the circumstances of the case, let the petitioners, above named, in the event of their arrest or surrender by them within six weeks from today, be enlarged on bail on their furnishing bail bond of Rs.10,000/-(Rupees Ten Thousand) each with two sureties of the like amount each to the satisfaction of the Chief Judicial Magistrate, Banka, in connection with Mahila P.S. Case No.13 of 2019, subject to the conditions laid down under Section 438(2) Cr.P.C.
