The petitioner apprehends his arrest in connection with Kothi P.S. Case No.42 of 2021 registered under Section 366A of the Indian Penal Code.

Learned counsel for the petitioner submits that the F.I.R. has been lodged after one week of the alleged occurrence. It is further submitted that during investigation, the police did not find any evidence against this petitioner nor the victim in her statement recorded under Section 164 of the Cr.P.C. has stated anything against the petitioner showing his involvement in the alleged crime as is evident from para 126 of the casediary. The petitioner has got no criminal antecedent. Having considered the above facts and circumstances

Patna High Court CR. MISC. No.42595 of 2022(4) dt.06-02-2023 2/2 of the case and the submissions advanced on behalf of the parties, let the above named petitioner be released on bail, in the event of arrest or surrender before the learned Court below within a period of four weeks from today, on furnishing personal bond to the satisfaction of Judicial Magistrate, 1st Class, Sherghati, Gaya in connection with Kothi P.S. Case No.42 of 2021, subject to the conditions as laid down under Section 438(2) of the Cr.P.C.
