The petitioners apprehend their arrest in Hilsa P.S. Case No. 140/2016 registered under Section 307 and other sections of the Indian Penal Code and Section 27 of the Arms Act. The informant named the two petitioners, namely, Jaynarayan Yadav and Dayanand Yadav along with other accused persons but did not make any specific allegation against the petitioners. It is alleged that Satan Yadav demanded extortion and also assaulted the informant due to non-payment of extortion. It is submitted that on account of enmity, the petitioners have been falsely implicated in the case. Similarly situated nine accused persons, namely, Jitendra Yadav @ Jitendra Kumar and others have been granted anticipatory bail vide orders passed in Cr. Misc.

Patna High Court Cr.Misc. No.55292 of 2016 (2) dt.11-01-2017 2/2 No. 42200/2016 and Cr. Misc. No. 54111/2016. The case of the petitioner stands on similar footing.

Considering the facts aforesaid, the above named petitioners, in the event of their arrest or surrender before the learned court below within a period of four weeks from the date of receipt / production of a copy of this order, are directed to be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Ten thousand) each with two sureties of the like amount each to the satisfaction of the learned Additional Chief Judicial Magistrate II, Hilsa, Nalanda in Hilsa P.S. Case No. 140/2016, subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure.
