The petitioner apprehends his arrest in connection with a case registered for the offences punishable under Sections 272/273 of the Indian Penal Code and 47/52/53 of the Bihar Excise Act, 2016.
It is submitted on behalf of the petitioner that the alleged recoveries were not made from his conscious possession, but from a 'Gothaul' which was near his house and only on account of local village politics, the petitioner has been implicated in the present case.
Considering the nature of allegations and that the petitioner has no criminal antecedent, let the petitioner abovenamed, in the event of his arrest / surrender within a period of four weeks from
Patna High Court Cr.Misc. No.47269 of 2016 (2) dt.10-11-2016 P2/2 the date of receipt/production of a copy of this order, be enlarged on bail on furnishing bail bonds of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of the learned Additional Chief Judicial Magistrate, Motihari, East Champaran, in connection with Pakaridyal P.S. Case No. 102/2016, subject to the conditions as laid down under Section 438(2) of the Cr. P.C.
