The petitioner apprehends his arrest in G.O. Case No. 493/2015 registered under Section 47(A) of the Bihar Excise Act. It is alleged that the place from where 40 litres of country made liquor and 600 Kg of Jawa Mahua were recovered belongs to the petitioner. It is submitted that the petitioner is not the owner of the abandoned place from where the liquor was recovered. The name of the petitioner figured in the prosecution report at the instance of a villager due to enmity. The house of the petitioner has not been searched and nothing has been recovered from the possession of the petitioner.
Considering the facts aforesaid, the above named petitioner, in the event of his arrest or surrender before the learned court below within a period of four weeks from the date of receipt
Patna High Court Cr.Misc. No.39896 of 2016 (2) dt.19-09-2016 2/2 / production of a copy of this order, is directed to be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of Sri Sujit Kumar, Judicial Magistrate 1st Class, Nawada G.O. Case No. 493/2015, subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure.
