Petitioner apprehends arrest in Bhagwan Bazar Police Station Case No 267 of 2017 registered under Sections 147, 148, 149, 341, 323, 332, 333, 307, 353, 436, 427, 504, 115 of Indian Penal Code.
The prosecution case alleges participation of 300 to 400 villagers in the occurrence. It is submitted by the learned counsel for the petitioners that the family members of deceased Guddu Ray were demanding fair trial but the police, to subvert the legitimate demand of the mob, opened fire. Petitioners' counsel submits that the petitioners have no connection with the
Patna High Court Cr.Misc. No.65713 of 2018(2) dt.14-12-2018 2/2 occurrence and that they have falsely been implicated in this case on the basis of vague and omnibus allegations. Considering the aforesaid submissions, prayer for anticipatory bail is allowed. In the event of their arrest or surrender before the Court below within four weeks from today, the petitioners above named shall be released on bail on each of them furnishing bonds of Rs 10,000/- (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of Assistant Chief Judicial Magistrate I, Saran at Chapra in Bhagwan Bazar Police Station Case No 267 of 2017 subject to all conditions as laid down in Section 438 (2) of Criminal Procedure Code.
