The petitioner apprehends his arrest in Hulasganj P.S. case No. 188 of 2018 registered under Section 341, 323, 504, 506, 354, 427, 379/34 of the IPC.
The petitioner and others are alleged to have assaulted the informant and his family members, snatched different articles and ornaments from their possession. It is submitted that petitioner is alleged to have assaulted the informant with piece of brick but similarly situated accused Anuj Kumar and Vikash Kuamr have already been granted anticipatory bail. All the offences save and except Section 379 of the IPC are bailable and there is no allegation of theft against the petitioner.
Considering the facts aforesaid and nature of
Patna High Court CR. MISC. No.39869 of 2019(2) dt.28-06-2019 2/2 allegation made against the petitioner, the petitioner, above named, in the event of his arrest/ surrender before the court below within a period of four weeks from the date of receipt/ production of a copy of this order is directed to be enlarged on bail on his furnishing bail bond of Rs. 10,000/- (rupees ten thousand) with two sureties of the like amount each to the satisfaction of learned Sub divisional Judicial Magistrate, Jehanabad in connection with Hulasganj P.S. case No. 188 of 2018, subject to conditions as laid down under Section 438(2) of the Code of Criminal Procedure.
