ANJANA MISHRA ORAL ORDER 16-10-2015 Heard learned counsel for the petitioners and learned counsel appearing on behalf of the State.

The petitioners are apprehending their arrest in connection with Salkhua P.S. Case No.257 of 2014 which was initially registered under section 364 of the Indian Penal Code but later on sections 302 and 120B of the Indian Penal Code have been added.

Learned counsel for the petitioners submits that the present case has been lodged only because the petitioners have filed a case being Salkhua P.S. Case No.167 of 2012 since the cousin brother of the petitioners had been murdered in which the deceased Sakaldeep Yadav and Dinesh Yadav were accused.

Patna High Court Cr.Misc. No.21902 of 2015 (3) dt.16-10-2015 2/2 Learned counsel further submits that both these petitioners are the witnesses of the aforesaid case and, therefore, they have been named in the connection with disappearance of the husband of the informant.

Considering the aforementioned facts and circumstances of the case, let the petitioners, above named, in the event of arrest or surrender before the court below within a period of four weeks from the date of receipt/production of a copy of this order, be released on bail on furnishing bail bonds of Rs.10,000/- (ten thousand) each with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Saharsa in connection with Salkhua P.S. Case No.257 of 2014, subject to the conditions as laid down under section 438(2) of the Code of Criminal Procedure.
