2. The present criminal miscellaneous application has been filed under Section 482 of the Bharatiya Nagarik Suraksha Sanhita, 2023 (hereinafter referred to as 'the BNSS, 2023') for grant of anticipatory bail to the petitioner who apprehends arrest in connection with Udakishunganj P.S. Case No. 144 of 2025, lodged on 05.05.2025, under Section 30(a) of the Bihar Prohibition and Excise (Amendment) Act, 2018.

3. As per the prosecution, total recovery of about 49 litres of foreign liquor has been made which is the subject matter of the present case.

4. Learned Counsel for the petitioner submits that the

Patna High Court CR. MISC. No.42439 of 2025(2) dt.09-07-2025 2/2 petitioner is innocent and has committed no offence. Counsel submits that nothing has been recovered from his conscious possession. He submits that his name has been indicated by the local Chaukidar.

5. Learned APP for the State opposes the prayer for bail of the petitioner and submits that antecedent of the petitioner is not clean. There are total five criminal cases pending against the petitioner and four cases are of identical nature.

6. Considering the criminal antecedents of the petitioner, this Court is not inclined to grant anticipatory bail to the petitioner. Hence, the prayer for anticipatory bail of petitioner is hereby refused.
