JUSTICE PRABHAT KUMAR JHA ORAL ORDER 08-10-2015 Learned counsel for the petitioners submits that petitioner no. 2, namely, Nageshwar Pasi @ Nageshar Pasi, has already been arrested. Accordingly, the anticipatory bail petition of the petitioner no. 2 is dismissed as has become infructuous. Heard both sides.

The petitioner nos. 1, 3, 4, 5 & 6 (five in number) apprehend their arrest in a case under Section 307 and other sections of the Indian Penal Code.

The petitioners are named in the F.I.R. but the allegation against the petitioner no. 1 Dilip Pasi is that he assaulted the informant with Farsa on his head. Petitioner no. 1 also assaulted Sobha Kumari, the grand-daughter of the informant.

No.22117 of 2015 (4) dt.08-10-2015 2/2 There is no specific allegation against Bijay Pasi (petitioner no. 4), Uma Pasi (petitioner no. 5) and Kalap Nath Pasi @ Kalf Nath Pasi (petitioner no. 6). Dudhnath Pasi (petitioner no. 3) is alleged to have taken away Rs. 1000/- from the house. It is submitted that there is a counter-version. The occurrence took place due to land dispute. The informant and his men brutally assaulted the wife of the petitioner no. 1 and others. The injuries found on the persons of Shibji Sah and Sobha Kumari are simple in nature, caused by hard and blunt object.

Considering the facts aforesaid, the above named petitioner nos. 1, 3, 4, 5 & 6, in the event of their arrest or surrender before the learned court below within a period of four weeks from the date of receipt / production of a copy of this order, are directed to be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Ten thousand) each with two sureties of the like amount each to the satisfaction of the learned Chief Judicial Magistrate, Gopalganj in Manjhagarh P.S. Case No. 157/2014, subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure.
