The petitioner apprehends his arrest in a case under Section 420, 406 of the Indian Penal Code and under section 138 of the N. A. Act.

The complainant alleged that the petitioner requested him to deposit Rs. 35,000/- on the condition that he would get a Hero Honda motorcycle but no motor cycle was given to the complainant. On demand the petitioner issued two cheques each of Rs. 10,000/- but both the cheques were dishonoured. It is submitted that petitioner happens to be own cousin of the complainant. The complainant stealthily took

Patna High Court Cr.Misc. No.51311 of 2015 (2) dt.15-12-2015 2/2 cheques of the petitioners and filed this false case. Considering the facts aforesaid and the nature of allegations made against the petitioner, the above named petitioner, in the event of his arrest or surrender before the learned court below within a period of four weeks from the date of receipt / production of a copy of this order, is directed to be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of the learned Chief Judicial Magistrate, East Champaran, Motihari in complaint Case No. 662 of 2013, Trial No. 1347 of 2015, subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure.
