2. The petitioner apprehends his arrest in a case registered for the offences punishable under Sections 302, 34, 120(B) of the Indian Penal Code.

3. As per the prosecution case, petitioner along with other co-accused persons committed the murder of husband of informant.

4. It is submitted by the counsel for petitioner that informant is not eye-witness of the occurrence. Due to political rivalry petitioner has been made accused in this case. Petitioner on the alleged date and time of occurrence was at his office Bankatwa Block, Motihari Purwi Champaran. Petitioner claims clean antecedents.

5. Counsel for State however vehemently opposed the

Patna High Court CR. MISC. No.43851 of 2023(2) dt.07-08-2023 2/2 prayer for bail and submitted that petitioner is named in the FIR.

6. Considering the facts aforesaid and gravity of offence, I am not inclined to enlarge the petitioner above-named on anticipatory bail in connection with Kalyanpur P.S. Case No. 473 of 2022. Accordingly, the same is rejected. (Prabhat Kumar Singh, J) vinita/- U T
