KUMAR ORAL ORDER 06-10-2018 Heard learned counsel for petitioner, learned counsel for the informant and learned counsel for the State. Petitioner, who is in custody, seeks bail in connection with Amas P.S. Case No. 115 of 2018 registered for the offences punishable under Sections 447, 302 and 34 of the Indian Penal Code and under Section 27 of the Arms Act. Informant who is the brother of the deceased has alleged that when he was sleeping along with his family members, petitioner and other co-accused persons came to his house and fired upon his brother from window. It has been submitted on behalf of the petitioner that he is innocent and has committed no offence. He has been falsely implicated in this case due to previous dispute. He was neither present at the place of occurrence nor participated in the

Patna High Court Cr.Misc. No.56381 of 2018(3) dt.06-10-2018 2/2 alleged occurrence. He is in custody since 18.06.2018. It has been further submitted that similarly placed co-accused has been granted bail by co-ordinate Bench of this Court in Cr. Misc. No. 53386 of 2018 vide order dated 05.10.2018.

Considering the aforesaid fact and circumstances of the case, let the petitioner named above be released on bail upon furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned Additional Chief Judicial Magistrate, Sherghati at Gaya in connection with Amas P.S. Case No. 115 of 2018, subject to verification of his criminal antecedent. Petitioner has stated in his petition that he was made accused in Amas P.S. Case No. 204 of 2015 and Amas P.S. Case No 45 of 2016 which has been found to be not true and he is not accused in any other case which is being disputed by counsel for informant. (S. Kumar, J) Rajiv/ManojU T
