2. Learned counsel for the petitioners seeks permission to withdraw the present application for the petitioner no. 1, namely, Niranjan Kumar Paswan.
3. Permission is accorded.
4. Accordingly, the present application for the petitioner no. 1, namely, Niranjan Kumar Paswan is dismissed as withdrawn.
5. The petitioners are apprehending their arrest in a case in connection with Motihari Muffasil P.S. Case No. 471 of 2023
Patna High Court CR. MISC. No.46790 of 2025(2) dt.28-07-2025 2/3 dated 03.07.2023 registered for the offences punishable u/ss 147, 148, 149, 333, 353, 341, 427, 504, 506 of the Indian Penal Code and u/s 3/4 of the Damage of Public Property Act.
6. As per the prosecution case, 42-45 unknown miscreants are alleged to have blocked the main road and they were burning tires on the road and causing damage to the public vehicles. The informant tried to pacify the situation but the accused persons started raising slogans against the police party. In the meantime, the accused persons holding lathi, danda, bricks and stones attacked the police party due to which they sustained injury. It is further alleged that the accused persons caused hindrance in discharge of official duty of the informant and the other police officials.
7. Learned counsel for the petitioners has submitted that the petitioners are innocent and have falsely been implicated in this case. The name of the petitioners was disclosed by the apprehended co-accused persons. There is general and omnibus allegation against the petitioners. It is further submitted that the petitioners have no concern with the alleged offence. The petitioners have no criminal antecedent as stated in para 3 of the bail petition.
8. Learned A.P.P. for the State has vehemently opposed the bail petition of the petitioners.

9. Considering the aforesaid facts and circumstances of the case as well as the nature of allegation against the petitioners, let the above named petitioners no. 2 and 3, in the event of their arrest/surrender within a period of six weeks from today, be enlarged on bail on furnishing bail-bond of Rs. 20,000/- (Rupees Twenty thousand) each with two sureties of the like amount each to the satisfaction of learned court concerned, Motihari, East Champaran in connection with Motihari Muffasil P.S. Case No. 471 of 2023, subject to conditions as laid down under Section 482(2) of the BNSS.
10. This application stands allowed.
