The petitioner seeks bail in Barbigha (Mission O.P.) P.S. Case No. 280/2018, Excise Case No. 219/2018, instituted for offence under Section(s) 341, 323, 354, 504, 506/34 of the Indian Penal Code read with Section 37(C) of the Bihar Prohibition and Excise Act, 2016.

It is alleged in the written report that on the date of occurrence at about 7:30 P.M., accused persons including this petitioner were taking drink in front of the house of informant. Husband and son of informant were not present in the house. Informant made protest then they abused her and tried to outrage her modesty. The accused persons snatched golden chain from her neck. They also entered into the house of

Patna High Court CR. MISC. No.39904 of 2019(2) dt.03-07-2019 2/2 informant and assaulted her. The accused persons also assaulted the husband and son of informant when they came to house. Learned counsel for the petitioner has submitted that there is no any injury sustained by any person. The other co-accused persons have already been granted bail by a Co-ordinate Bench of this Court vide order dated 28.03.2019 passed in Cr. Misc. No. 17337/2019. Petitioner is in custody since 12.06.2019.

Considering the aforesaid facts and circumstances, prayer of the petitioner for grant of bail is allowed. Let the petitioner, above named, be released on bail on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of the learned 2nd Addl. District & Sessions Judge, Sheikhpura, in connection with Barbigha (Mission O.P.) P.S. Case No. 280/2018, Excise Case No. 219/2018, subject to the conditions that both the bailors shall be the close relative of the petitioner.
