Heard learned counsel for the petitioners and learned A.P.P. for the State.

The petitioners seek regular bail in connection with Kudra P.S. Case No. 78 of 2021 (G.R. No.384 of 2021), lodged under Sections 147, 149, 341, 323, 325, 307, 504, 506 of the Indian Penal Code.

As per prosecution case, fight was going on between Ramashankar Bind and Basant Bind, they reached at the house of Jagdish Bind to settle the dispute but they all started assaulting Jagdish Bind, who was injured and admitted to hospital, subsequently died in hospital during treatment, thereafter the present case has been filed.

Learned counsel for the petitioners submits that petitioners are innocent and have committed no offence. He further

Patna High Court CR. MISC. No.42187 of 2022(2) dt.02-11-2022 2/2 submits that both the petitioners are not criminal and their antecedents are clean. He also submits that petitioners are in custody since 28.04.2022. It has also been submitted that other coaccused persons have already been granted bail by the Co-ordinate Bench of this Court vide orders dated 15.04.2022 & 29.04.2022 passed in Cr. Misc. Nos.63346 of 2021 & 67979 of 2021 respectively.

Learned counsel for the State opposes the prayer for bail.

In the present facts and circumstances of this case and the submissions made above, let the petitioners above named, be granted bail on furnishing bail bonds of Rs.30,000/- (Rupees Thirty thousand) each with two sureties of the like amount each to the satisfaction of learned Additional Chief Judicial MagistrateVIII, Kaimur at Bhabha in connection with Kudra P.S. Case No. 78 of 2021, subject to the conditions as laid down under Section 437(3) of Cr.P.C.

With this observation, the bail application stands allowed.
