The petitioners seek bail in anticipation of their arrest in connection with Shambhuganj P.S. Case No. 80 of 2020, dated 07.04.2020, instituted for the offences under Sections 269, 270, 271, 419, 420 and 34 of the Indian Penal Code.

Patna High Court CR. MISC. No.4100 of 2021(2) dt.10-12-2021 2/2 The accusation in the F.I.R. is that the petitioners and others had beached the COVID-19 protocol and had came on a four-wheeler along with other persons to Banka from Madhubani.

Regard being had to the nature of accusation and nothing on record to indicate that the mischief of Sections 419 or 420 of the I.P.C. is attracted, the petitioners, in the event of their arrest or surrender before the learned Court below within a period of four weeks, are directed to be released on bail on their furnishing bail-bonds in the sum of Rs. 10,000/- (Rupees Ten Thousand) each with two sureties of the like amount each to the satisfaction of learned Addl. Chief Judicial Magistrate-IV, Banka in connection with Shambhuganj P.S. Case No. 80 of 2020, subject to the conditions laid down under Section 438(2) of the Cr.P.C. The application stands allowed.
