The petitioner is in custody in connection with Buxar (I) P.S. Case No. 49 of 2019 for the offenses under Section 290 of the Indian Penal Code, and U/S 30(a) of the Bihar Prohibition and Excise Act, 2016.
Learned counsel for the petitioner submits that in the instant case total 423.360 ltrs of foreign liquor was seized. The petitioner has no criminal antecedent. The petitioner was not arrested from the place of occurrence. He further submits that the police persons entered the territory of U.P. to seize the liquor and apprehended the accused person. In U.P. there is no prohibition and as such, the provisions of Bihar Prohibition and Excise Act is not applicable. The petitioner is in custody since

Considering the facts and circumstances discussed hereinabove, the Court is inclined to grant bail to the petitioner. Let the petitioner, above named, be enlarged on bail on furnishing bail bond of Rs. 10,000/-(Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned Additional District Judge II - cum - Special Judge, Buxar in connection with Buxar(I) P.S.
