JUSTICE ASHUTOSH KUMAR ORAL ORDER 10-01-2022 Heard Mr. Rajesh Kumar Sinha, learned counsel for the petitioners and learned APP for the State. The petitioners seek bail in anticipation of their arrest in connection with Jamui P. S. Case No. 390 of 2020, instituted for the offences under Sections 341, 323, 307, 447, 504 and 34 of the Indian Penal Code. Several persons have been made accused in this case with the allegation of assault. The petitioners are specifically alleged to have assaulted the informant by means of lathi and sword.

Patna High Court CR. MISC. No.17645 of 2021(2) dt.10-01-2022 2/3 submitted that there is a counter version of the occurrence lodged by petitioner no. 1, in which both the petitioners have received injuries.

Almost all the accused persons of the counter case have been released on anticipatory bail. One of the injuries suffered by the informant though is stated to be grievous but from the dimensions of such injury, it does not appear to be life threatening. The learned counsel for the petitioners has submitted that though sword is said to have been used in the assault by the petitioners but there is no sharp cut injuries on the victim.

Apart from this, it has been submitted that because of land dispute, an occurrence took place in which both sides have been injured.

Considering the afore-stated facts and taking into account that they do not have criminal antecedents and also the occurrence arose because of a dispute over a piece of land, the petitioners, above-named, in the

No.17645 of 2021(2) dt.10-01-2022 3/3 event of their arrest or surrender before the court below within a period of six weeks, are directed to be released on bail on their furnishing bail bonds in the sum of Rs. 10,000/- (Rupees Ten Thousand) each with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Jamui, in connection with Jamui P. S. Case No. 390 of 2020, subject to the conditions laid down under Section 438(2) of the Cr.P.C. This petition stands allowed.
