JUSTICE VINOD KUMAR SINHA ORAL ORDER 09-10-2018 Heard learned counsel for the petitioner and the State. The petitioner is an accused in a case under Sections 406, 419 and 420 of the Indian Penal Code.

Allegation against the petitioner as per F.I.R. is that when the informant went to S.B.I. ATM at Jamalpur branch some miscreants entered in the ATM room and at the time of removal of ATM, his card fell down then one of the miscreants took the card and handed over him and went away from there. Thereafter the informant returned back and in the night he got message on his mobile that an amount of Rs.50, 600/- has been withdrawn from his account. The petitioner is not named in the F.I.R. He has been arrested on the basis of confessional statement of co-accused and two ATM cards were also recovered from his possession and it

Patna High Court Cr.Misc. No.54254 of 2018 (3) dt.09-10-2018 2/2 further appears that seven other criminal cases having similar nature have been registered against the petitioner. Learned counsel for the petitioner submits that nothing has been recovered from the possession of the petitioner. He has not been put on T.I.P. He is in custody since 14.05.2018. Other accused has been granted bail by the court below itself. Heard learned APP appearing for the State.

In view of the fact and circumstances of the case, let the above named petitioner be enlarged on bail on furnishing bail bond of Rs. 25,000/- (rupees twenty five thousand) with two sureties of the like amount each to the satisfaction of learned C.J.M., Munger in connection with Jamalpur P.S. Case No.67 of 2018.
