1. The present petition has been filed for restoration of a writ petition bearing CWJC No.17772 of 2022, which has
Patna High Court MJC No.1971 of 2024(4) dt.24-01-2025 2/2 stood dismissed on account of non-prosecution, by an order dated 16.04.2024.
2. The learned counsel for the petitioners has submitted that the earlier counsel could not appear before this Court when the aforesaid case was called out for hearing on 16.04.2024 for reasons best known to him, leading to the aforesaid writ petition having stood dismissed for default, however, the petitioners had then taken no objection from the earlier counsel and have engaged the present counsel, who submits that the aforesaid writ petition shall henceforth be prosecuted diligently, thus it is submitted that a sympathetic view be taken and the aforesaid writ petition be restored to its original file.
3. Having regard to the submission made by the learned counsel for the petitioner as also considering the averments made in the present petition, I deem it fit and proper to restore the aforesaid writ petition bearing CWJC No.17772 of 2022 to its original file.
