====================================================== CORAM: HONOURABLE MR. JUSTICE BIRENDRA KUMAR ORAL ORDER 13-04-2021 Heard the parties in virtual Court.

The petitioner is languishing in custody for the offence punishable under Sections 302, 307 and 120B/34 of the Indian Penal Code and Section 27 of the Arms Act. Petitioner is in custody since 08.01.2020.

Submission is that the F.I.R. of the occurrence of murder is against unknown. Name of the petitioner surfaced in the confessional statement of co-accused. Besides confessional statement of co-accused before the police, there is no other material against the petitioner save and except criminal antecedent of the petitioner.

Considering lack of material against the petitioner in this case and completion of investigation of the case as well as

No.38652 of 2020(3) dt.13-04-2021 2/2 no material to substantiate that the petitioner is going to tamper with the evidence, let the petitioner, above named, be released on bail on furnishing bail bond of Rs.20000/- (Twenty thousand) with two sureties of the like amount each to the satisfaction of the learned Court-below where the case is pending in connection with Madhuban P.S. Case No. 153 of 2013, with following conditions:

(a) Both the bailors shall be the resident of territorial jurisdiction of the learned Court-below.

(b) The petitioner shall fully cooperate with the trial of the case, failing which the court below shall be at liberty to cancel the bail bond of the petitioner.

(c) The petitioner shall not leave the country without permission of the trial Court.
