2. Let the defect(s), if any, be removed within a period of four weeks from today.

3. The petitioner seeks bail in connection with SourBazar (Baijnathpur O.P.) P.S. Case No. 184 of 2022 registered for the offence under Sections 302 and 120-B of the Indian Penal Code and under Section 27 of the Arms Act.

4. As per the prosecution case, the deceased was killed on a railway crossing by unknown persons and the wife of the deceased has registered the FIR against six named persons that they have killed the deceased because of political rivalry.

5. Learned counsel for the petitioner submits that the petitioner is not named in the FIR and his name has surfaced on the statement of pillion rider one Pappu Yadav who said that he identified the petitioner after seeing his photo on facebook.

6. Learned counsel for the petitioner also submits that the petitioner is in custody since 30.09.2022.

7. Learned A.P.P. has vehemently opposed the prayer for bail.

8. Considering the aforesaid facts and the period of custody, this application for regular bail is allowed.

9. Let the petitioner, above named, be released on bail after framing of charge if the charge is not framed yet and on furnishing bail bond of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned Judicial Magistrate, 1st Class, Saharsa in connection with Sour-Bazar (Baijnathpur O.P.)
