The petitioner apprehends his arrest in Buxar (T) P.S. Case No. 407 of 2016 instituted for the offence under Sections 237, 238, 406, 420, 349 of the Indian Penal Code and 66 of I.T. Act.
It is alleged that petitioner along with one Sanjay Pal introduced the informant to Vijay Kumar Rastogi. Vijay Kumar Rastogi told the informant about different plans for investment and on such inducement, informant invested total amount of Rs.2,00,000/- along with his friend Manoj Kumar Singh. No receipt was given to him about the aforesaid investment. Later on he learnt in newspaper that Vijay Kumar Rastogi is a cheater and
Patna High Court Cr.Misc. No.44776 of 2016 (3) dt.18-01-2017 2/2 he has also cheated the other people of the locality. He indulged in illegal transaction. In this manner, from written report itself it appears that there is specific allegation of overt act against Vijay Kumar Rastogi, who has already been granted regular bail by Coordinate Bench of this court vide Cr. Misc. No. 44710 of 2016 dated 17.10.2016. The petitioner is alleged to have introduced the informant to Vijay Kumar Rastogi. In the circumstances, prayer of the petitioner for anticipatory bail is allowed. In the event of surrender/arrest of the petitioner, named above, within six weeks from today in connection with Buxar (T) P.S. Case No. 407 of 2016, he shall be released on anticipatory bail on furnishing bail bond of Rs.10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Buxar, subject to the conditions as laid down under Section 438(2) Cr.P.C.
