15-09-2017 Heard Sri Dhurendra Kumar, learned counsel for petitioners and Sri Rajballabh Singh, learned Addl. Public Prosecutor.
Two petitioners, who are in custody since 22-06-2017 in Excise Case No. 169 of 2017, arising out of Excise PR No. 04 of 2017-18 (Dhaka) registered for offence under Section 30(A) of Bihar Prohibition and Excise Act, 2016, have prayed for grant of bail.
It was submitted by learned counsel for the petitioners that on accusation of recovery of about 10 liters of Nepali country-made liquor, petitioners were apprehended and are in custody since then.
Patna High Court Cr.Misc. No.42003 of 2017(2) dt.15-09-2017 2/2 Learned Addl. Public Prosecutor has opposed the prayer for bail.
Considering the nature of accusation as well as period of custody, let both the petitioners namely Uma Shankar Das and Raj Narayan Das be enlarged on bail on furnishing bail-bond of Rs. 10,000/- (ten thousand) each with two sureties of the like amount each to the satisfaction of learned 7th Additional Sessions Judge cum Special Judge, Excise, East Champaran, Motihari in connection with Excise Case No. 169 of 2017, arising out of Excise PR No. 04 of 2017-18 (Dhaka).
