The petitioners apprehend their arrest in a case registered for the offences punishable under Sections 307, 323 and other allied sections of the Indian Penal Code and section 27 of the Arms Act.

As per the prosecution case, co-accused Kare Yadav is alleged to have fired which hit the brother of informant Malik Yadav.

It is submitted that there is general and omnibus allegation against all the accused persons including petitioners and no specific overt act has been alleged against petitioners.

Patna High Court CR. MISC. No.42852 of 2022(3) dt.08-12-2022 2/2 Similarly situated co-accused have been granted bail by this Court vide order dated 26.08.2021 passed in Cr. Misc. No. 3642 of 2021. Petitioners claim clean antecedents. Considering the facts aforesaid, the petitioners abovenamed, in the event of their arrest/surrender before the court below within a period of six weeks from the date of receipt/production of a copy of this order, are directed to be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Ten thousand) each with two sureties of the like amount each to the satisfaction of the learned Sub-Divisional Judicial Magistrate, Udakishunganj, Madhepura in connection with Chausa P.S.
