The petitioner seeks bail in anticipation of her arrest in connection with Bodh Gaya P.S. Case No. 447 of 2020 instituted for the offences punishable under Sections 30(a) of the Bihar Prohibition and Excise Act.

Learned counsel for the petitioner submits that the petitioner is the wife of the owner of the house alleged to be from where liquor has been recovered.

Taking into consideration that the petitioner is a lady, and the house is not in her name, exfacie Section 30(a) of the Act is not made out, I am inclined to allow the petitioner on bail, in the event of arrest she shall be released on anticipatory
