2. The petitioner seeks bail in connection with Maheshkhunt P.S. Case No. 165 of 2024 dated 17.09.2024 registered for the offence punishable under Sections 126(2), 115(2), 109, 103(1) and 3(5) of the Bharatiya Nyaya Sanhita, 2023.

3. The prosecution case, in short, is that on the date of occurrence cow of Naresh Singh and the informant started fighting and when the informant and her husband went to sort it out, meanwhile, all the accused persons started assaulting them. It is further alleged that the

Patna High Court CR. MISC. No.40544 of 2025(3) dt.03-09-2025 2/3 petitioner assaulted with bamboo on the person of the deceased, who fell down on the ground and died during treatment.

4. Learned counsel for the petitioner submits that the petitioner is innocent and has been falsely implicated in this case. It is submitted that both the sides are agnates. It is submitted that no external injury found is in the postmortem which falsify the case of the prosecution. The postmortem report is available on record. It is further submitted that there is land dispute between both the parties. Lastly, it has been submitted that the petitioner is in custody since 22.04.2025, having no criminal antecedent and charge-sheet has been submitted in the case.

5. Learned A.P.P for the State and learned counsel for the informant vehemently opposed the prayer for bail of the petitioner. Learned counsel for the informant submits that there is specific allegation of assault by the petitioner on the person of the deceased.

6. Having considered the facts and circumstances of the case and submissions of learned counsel for the parties, let the petitioner be released on bail upon furnishing

Patna High Court CR. MISC. No.40544 of 2025(3) dt.03-09-2025 3/3 bail bonds of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of the learned Judicial Magistrate-Ist Class, Khagaria in connection with Maheshkhunt P.S. Case No. 165 of 2024.
