The petitioner prays for anticipatory bail in connection with Durgawati P.S. Case No. 64 of 2005 registered for the offences punishable under Sections 307, 448, 323, 114, 34 of the Indian Penal Code. Allegation against the petitioner is that petitioner is the order giver.

It has been submitted on behalf of the petitioner that petitioner is only order giver there is no any allegation against the petitioner. It has further been submitted that by filing supplementary affidavit that even the injury cased by the informant simple in nature. Learned A.P.P. opposes the prayer of bail application. Considering the facts and circumstances of the case, petitioner is only the order giver, having no criminal antecedent, let the petitioner, above named, in the event of his arrest or surrender before the

Case No. 64 of 2005, subject to the condition laid down under Section 438 (2) of the Code of Criminal Procedure.
