The sole petitioner who is in custody since 18.06.2017 in Excise Case No. 1950 of 2017 [arising out of Barahara ( Krishnagarh) P.S. Case no. 175 of 2017 ] registered for offence under section 414 of the Indian Penal Code 1860 and Section 30(a), 56(d) of Bihar Prohibition and Excise Act , 2016 has prayed for grant of bail.
Learned counsel for the petitioner by way of referring to statement made in paragraph no. 3 of the petition submits that petitioner is having clean antecedent. He has further argued petitioner was driver of a vehicle and he was driving the vehicle of one Niraj Kumar Singh and from the said vehicle
Patna High Court Cr.Misc. No.41486 of 2017(2) dt.15-09-2017 2/2 recovery of huge quantity of Indian make foreign liquor was shown .
Learned Additional Public Prosecutor has opposed the prayer of bail.
However, considering the nature of accusation, clean antecedent of the petitioner as well as period of custody, let the petitioner Bade Singh @ Sanjit Singh @ Sanjeet Singh be enlarged on bail on furnishing bail bond of Rs. 10,000/- ( rupees ten thousand) with two sureties of the like amount each to the satisfaction of learned 4th Additional Sessions Judge, Bhojpur at Ara/ concerned court in connection with Excise Case No. 1950 of 2017 [ arising out of Barahara ( Krishnagarh) P.S. Case No. 175 of 2017].
