Let the defect(s), if any, be removed within a period of four weeks from today.

The petitioner seeks bail in connection with Buddha Colony P.S. Case No. 157 of 2023 registered for the offence under Sections 376, 511 of the Indian Penal Code and under Section 8 of the Protection of Children from Sexual Offence Act.

As per the prosecution case, the petitioner has misbehaved with a 14 year old girl.

It has been submitted by the learned counsel for the petitioner that the petitioner runs a girls hostel and because of the dispute, he has falsely been implicated in this case. Learned counsel for the petitioner further submits that no statement under Section 164 of the Cr.P.C. has been recorded by the

Patna High Court CR. MISC. No.45624 of 2023(2) dt.04-08-2023 2/2 victim. During investigation, the victim has supported the prosecution case in her statement.

In view of the aforesaid fact, this Court is not inclined to grant bail to the petitioner.

Accordingly, the prayer of bail of the petitioner is rejected herewith.

The court below is directed to expedite the trial of all the cases in one court pending against the petitioner. The petitioner may renew the prayer for bail, after deposition of the victim.
