KUMAR ORAL ORDER 29-10-2018 Heard learned counsel for petitioner, learned counsel for the informant as well as learned counsel for the State. Petitioner, who is in custody, seeks bail in connection with S. Tr. No. 290 of 2018 arising out of Dehri (Indrapuri) P.S. Case No. 365 of 2018 registered for the offences punishable under Sections 341, 323, 338, 307, 504, 506, 34 and 302 of the Indian Penal Code.
Informant alleged that when he was sitting at his door, petitioner along with other co-accused came there and started abusing him and on protest assaulted his sons and thereafter fired upon the wife of the informant as result of which she sustained injuries on her stomach and thigh. It has been submitted on behalf of the petitioner that he is innocent. He has falsely implicated in this case due to
Patna High Court Cr.Misc. No.56860 of 2018(3) dt.29-10-2018 2/2 enmity. There is no specific allegation against petitioner. He has no criminal antecedent. He is in custody since 08.06.2018. Learned counsel for the informant has vehemently opposes the grant of bail.
Considering the aforesaid fact and circumstances of the case, let the petitioner named above be released on bail upon furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned 4th Additional Sessions Judge, Rohtas at Sasaram in connection with S. Tr. No. 290 of 2018 arising out of Dehri (Indrapuri) P.S. Case No. 365 of 2018.
