Let the defect (s), as pointed out by the office, be removed within a period of four weeks from today. The petitioner seeks bail in connection with a case registered for the offences punishable under Sections 420, 120(B) and 34 of the Indian Penal Code and Section 30(a) of Bihar Excise Prohibition and Amendment Act, 2018. Allegation is of recovery of 1425 litres of countrymade liquor from a truck bearing Registration No. JH05AA-4025 and one Alto car bearing Registration No. BR26E6185. Learned counsel for the petitioner submits that the petitioner is innocent and he has falsely been implicated in this case. It is further submitted that the petitioner has no concern with the
Patna High Court CR. MISC. No.42221 of 2022(2) dt.12-10-2022 2/2 alleged liquor. It is further submitted that the petitioner is neither the driver nor the owner of the said vehicles. It is also stated that he has been implicated in this case only on the basis of confessional statement of another co-accused, namely, Ranjan Kumar. Nothing has been recovered from the conscious possession of the petitioner. Petitioner is in custody since 09.07.2022, is a person with clean antecedent and charge-sheet has been submitted in the case.
Learned A.P.P. for the State opposes the prayer for bail of the petitioner.
Considering the facts and circumstances of this case, the above named petitioner is directed to be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Ten Thousand) only with two sureties of the like amount each to the satisfaction of the Court of learned Additional District & Sessions Judge, IX, cum Special Judge, Excise, II, Aurangabad, in connection with Jamhore P.S. Case No. 107 of 2022.
