JUSTICE SAMARENDRA PRATAP SINGH ORAL ORDER 28-08-2015 The petitioner challenges order of the SDO, Rajgir dated 1.12.2012, cancelling his PDS License no.146/2007. The petitioner submits that while passing cancellation order the Licensing officer has considered the inspection report without its service to him as well as he has not considered his show cause reply.
Counter affidavit has been filed stating that the gist of the allegations has already been mentioned in the show cause itself.
As there is a remedy of appeal this writ petition is disposed of with liberty to the petitioner to avail the remedy of appeal.
In case, petition for condonation of delay is filed, the same would be considered sympathetically, as the petitioner
Patna High Court CWJC No.14570 of 2013 (2) dt.28-08-2015 2/2 was pursuing the remedy before this Court.
The appellate authority would dispose of the appeal preferably within four months of its filing.
